This is Jade and I'm the lifeblood behind Bèl Photography!

Photography to me is something very personal, it's more than just a few snapshots in time to remember the important things... A photograph holds a piece of our hearts and our souls, and keeps them young forever! Looking back at a fond memory captured on film (or nowadays digitally) can incite emotions, free our minds from any current stresses and allow us to go back in time to enjoy that moment over and over again... A photograph is timeless and priceless and something that should never be taken for granted!

Beautiful memories last a life time and that is what I am here to offer, not just some snapshots but works of art where you and your loved ones are the stars, beautiful images that you will proudly display in your home and look back on with happiness and fond memories of that time in your lives!

Disclaimer - *When on my property, being in the house, studio or outdoors, yourself and your children are your own responsibility. I take no legal responsibility for injuries due to carelessness or bad behavior. Any damaged property in my home, studio or outdoors must be replaced by you as soon as possible. A photographic studio can be a dangerous place for young children as there are glass light bulbs everywhere as well as other heavy studio equipment such as stands and props etc... So parents must do their very best to keep their children out of mischief while I try to focus on taking beautiful photographs of your family!

Terms and Conditions of Trade



1. Definitions

“Author” In general, the first owner of copyright will be the author being the photographer.

“Client” means you, the party to this agreement.

“Copyright” means the copyright law of Australia which defines the legally enforceable rights of creators of creative and artistic works under Australian law.

“BP” means Bèl Photography

“Photography” means an image created by light falling on a light-sensitive surface, usually photographic film or an electronic imager such as a CCD or a CMOS chip. Most photographs are created using a camera, which uses a lens to focus the scene's visible wavelengths of light into a reproduction of what the human eye would see. The process and practice of creating photographs is called photography

"Photographs" means all photographic material furnished by BP, whether transparencies, negatives, prints or any other type of physical or electronic material.

“Session or Session Photo’s” being the photos produced for The Client”

“the License” means this document between the “Client” and BP

2. Copyright

The copyright in the photographs is owned by and retained by BP at all times throughout the world.

3. License to use

BP provides a full print release to all sessions, which comes into effect once full payment is made.

4. Photographers promotional use

Where an exclusive license is granted, BP will at all times retain the right to use the photographs in any manner and in any part of the world for the purpose of advertising and promoting BP work.

5. Ownership of materials

Title to all photographs remains the property of BP.

6. No Alteration

No alteration or manipulation of the image may be made without the permission of BP. This is due to the representation of the work provided being completed by BP.

7. Client Materials

The client accepts full responsibility for any materials that they supply for the use in photographs and that the materials are adequately insured against loss, damage or liability.

8. Payment

Payment by the client is required for the right to use the photographs. Deposit payments are expected 5 (five) days after the session is booked (where possible) to confirm availability. Or in some circumstances where needed, full payment can be made on the day of the session.

9. Indemnity and Risk

BP shall not be liable for any legal action, claim, or damages resulting from or arising out of the publication of the photographs or other use by the client. The client shall indemnify BP against any claims and/or damages against BP as a result of the client’s use of the photographs.

10. Limited Liability

These Terms do not affect the rights, entitlements and remedies conferred by the Trade Practices Act 1974.
BP is not subject to, and the Client releases BP from, any liability (including but not limited to consequential loss or damage) because of any delay in delivery or fault or defect in the Photograph’s. The Client acknowledges that the Company is not:

a) responsible if the Photograph’s do not comply with any applicable safety standard or similar regulation; and
b) liable for any claim, damage or demand resulting from such non-compliance.

If any statutory provisions under the Trade Practices Act 1974 or any other statute apply to the agreement between BP and the Client, then, to the extent to which BP is entitled to do so, BP’s liability under the statutory provisions is limited, at BP’s option, to:

a) replacement or repair of the Photograph’s or the supply of equivalent Photograph’s; or
b) payment of the original cost of the Photograph’s;

And in either case, BP will not be liable for any consequential loss or damage or other direct or indirect loss or damage.

11. Cancellation and postpones

Once BP has been commissioned, the booking can only be cancelled or postponed by giving notice to BP 7 days prior to the session date. Cancellation or postpones outside of this will incur a charge of $50.

12. Right to a credit

Where the photograph’s under the license are to be published publically on any form of internet publication (eg. social media) or Printed Material, BP's name will be stated in reasonable proximity to the published reproductions of the photographs unless agreed otherwise prior to the work commencing.

BP requests that the source photo is linked from The Client’s gallery on the BP website or Facebook page OR that a tagline be inserted in the description of the photo stating “Photo by Bèl Photography”.

13. Archiving

30 days after delivery of the Photo’s, BP will at its sole discretion archive the Session Photo’s from its online client gallery at any time. We recommend that the client makes a suitable backup of the Photo’s provided by BP.

14. Client confidentiality

BP will keep confidential and will not disclose to any third parties or make use of material or information communicated to it in confidence for the purpose of the photography save as may be reasonably necessary to enable it to carry out the work.

15. Variation

These terms will be varied from time to time. It is recommended that The client reads these terms each time they have a new booking to be aware of any obligations between themselves and BP.

16. Severability

If any provision contained in these Terms is held by a court to be unlawful, invalid or unenforceable, the validity and enforceability of the remaining provisions are not affected.

17. Applicable Law

This agreement is governed by the laws of Victoria, Australia.

18. Agreement by the Client
By making payment for the session booking, and accepting the terms and conditions during that payment, you agree to abide by these terms.
